ChatGPT Questions and Answers: What It Gets Wrong About Personal Injury Cases

More and more people are turning to tools like ChatGPT to answer legal questions. Recently, several of our clients have told us that they researched their personal injury case by asking ChatGPT how to handle the process on their own. Technology can certainly help find general
information, learn new concepts, or get a basic overview of a topic. However, it is important to understand the limitations of online tools, especially when dealing with something as serious and fact-specific as a personal injury claim.

Personal injury cases are rarely straightforward. Every case involves unique facts, different insurance policies, multiple parties, and specific legal rules that may apply. While AI tools can summarize general legal principles, they often cannot account for the nuances and procedural steps that can make a significant difference in the outcome of a case. To better understand the type of information people may be receiving when they rely on AI, we asked ChatGPT a straightforward question:

The Question: Handling Your Own Personal Injury Case

We asked ChatGPT 5.2: “How can I handle my own personal injury case in Georgia?” This is the type of question many people ask when they are trying to decide whether to hire an attorney or whether they can manage a claim themselves.

At the beginning of its response, ChatGPT included an important disclaimer stating that it is not an attorney and that the information provided should be considered general information rather than legal advice. That disclaimer is significant and appropriate. It is a reminder that tools like ChatGPT are not a substitute for professional legal counsel.

The response that followed contained a mixture of helpful general information and important omissions. This makes it a useful example of both the strengths and limitations of relying on technology for legal research.

Where ChatGPT Gets It Right

To its credit, ChatGPT provides some helpful guidance. It explains the basic concept of a personal injury claim and outlines several steps someone should take when they are injured and believe another party may be responsible.

It emphasizes the importance of seeking medical attention promptly. This is one of the most critical steps a person can take after an injury. Receiving timely medical care not only protects a person’s health but also creates medical records that can be important when documenting injuries in a claim.

ChatGPT also recommends documenting the incident. Taking photographs, writing down what happened, and preserving evidence can all be useful when determining how an injury occurred and who may be responsible.

In addition, the response suggests gathering witness information and obtaining an official report when available. Witness statements and police reports can provide valuable third-party documentation that may help establish liability or clarify what happened.

The tool also advises keeping records and receipts related to injuries and expenses. This includes medical bills, treatment records, prescription costs, and other expenses that may arise from an injury. Maintaining organized documentation is an important part of building any personal injury claim.

Finally, ChatGPT correctly mentions that Georgia generally has a two-year statute of limitations for personal injury claims. In many cases, this means a lawsuit must be filed within two years of the date of the injury. Missing this deadline can result in losing the ability to pursue a claim entirely. However, the statute of limitations is not always straightforward. There are circumstances in which the deadline may be shorter or longer depending on the specific facts. Claims involving government entities, minors, or specific procedural requirements can affect the timeline. Because of these variations, we always recommend speaking with an attorney early in the process to ensure important deadlines are not missed.

The Major Step ChatGPT Skips

Where the response begins to fall short is what comes next. After explaining the basic steps of documenting an injury and gathering information, ChatGPT suggests moving forward with preparing and sending a demand to the insurance company.

At first glance, that may sound reasonable. Demand letters are a common part of the personal injury process. However, several critical steps should occur before a demand letter is ever sent.

One of the most important steps is identifying and notifying all insurance companies that may provide coverage for the claim and requesting proof of coverage. Under Georgia law, specifically O.C.G.A. § 33-3-28, a request can be sent to insurance companies that may provide coverage. This request requires them to disclose details about the policies that may apply to the case.

This step is essential because it helps determine several key issues that may significantly impact how a case is handled. For example, disclosure helps determine which insurance policies are involved, how much coverage may be available, and which policies apply to the injuries being claimed. Possible coverage may include liability insurance carried by the at-fault party, uninsured or underinsured motorist coverage through the injured person’s own insurance policy, and medical payments coverage that may help cover medical expenses regardless of fault.

Each of these policies may cover different aspects of a claim. In some cases, multiple policies may apply simultaneously. Identifying these policies early allows us to evaluate how they interact and determine the best strategy for pursuing compensation. Without identifying and confirming the available coverage, someone handling their own case may not have a clear understanding of the financial resources that could be available to compensate them for their injuries. Sending a demand letter before this step is completed can lead to serious disadvantages. A demand that is sent without full knowledge of available insurance coverage may undervalue the claim or overlook important sources of recovery.

In some cases, failing to properly identify and notify the relevant insurance carriers early in the process can complicate negotiations or delay the resolution of a claim. These procedural steps are things experienced attorneys routinely handle but may not be obvious to someone researching the process online.

Common Mistakes and Negotiation Challenges

Even when someone carefully follows general advice from tools like ChatGPT, they may still encounter challenges. Insurance companies are experienced at evaluating claims, assessing liability, and minimizing payouts. A single mistake—such as sending incomplete documentation, misinterpreting coverage limits, or overlooking future medical costs—can reduce the compensation a person receives.

Negotiation strategies are also critical. Experienced attorneys understand how to present claims in a way that highlights damages, establishes liability, and maximizes recovery. Individuals handling claims alone may not know how to respond to counteroffers, evaluate settlement amounts, or identify when it may be necessary to escalate a case to litigation.

Additionally, cases can involve multiple insurance policies with overlapping coverage. Understanding which policy covers what and when multiple policies may be triggered is complex but essential. This is another area where professional guidance can prevent costly mistakes and ensure the claim is fully protected.

It is also worth noting that legal strategies evolve based on case-specific risks and opportunities. For example, some claims may benefit from early mediation, while others require filing suit promptly to protect certain rights. AI tools like ChatGPT cannot evaluate these nuances or anticipate how an insurance company might respond in a given situation.

The Hidden Risks of Handling Claims Alone

Many people underestimate the time, effort, and expertise required to manage a personal injury claim effectively. A seemingly minor misstep—such as failing to send proper notice to all relevant insurers, submitting incomplete medical records, or not understanding policy exclusions—can drastically limit recovery. Insurance adjusters are trained to detect inconsistencies, question documentation, and exploit gaps in a claimant’s knowledge. Without professional guidance, these small errors can lead to significantly lower settlements or outright claim denials.

Experienced attorneys not only help gather evidence and negotiate effectively but also anticipate future expenses related to injuries, including rehabilitation, lost income, and long-term care. AI tools cannot predict these future costs or properly quantify damages, which may result in a settlement that falls far short of what the injured party deserves.

Why This Matters

The example above illustrates why online tools, even advanced AI, should not replace legal guidance. Technology can provide helpful general information, but personal injury cases often involve detailed procedures, strategic decisions, and state-specific laws that are difficult to fully capture in a general explanation.

If key steps are overlooked, it can affect the outcome of the claim and reduce the potential compensation a person may recover. Personal injury cases often involve negotiations with insurance companies that handle claims daily. Having a clear understanding of the law, insurance coverage, and procedural requirements can make a significant difference.

Even beyond the legal and financial risks, handling a case alone can be emotionally draining. Injured individuals often must deal with pain, recovery, and personal responsibilities while simultaneously navigating complex legal and insurance processes. An attorney can shoulder much of this burden, allowing the injured party to focus on healing while ensuring their rights and financial interests are fully protected.
